The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks quashing of FIR No. 742/20241 registered at P.S. Jyoti Nagar, Delhi under Sections 420/467/471/448/120-B of the Indian Penal Code, 1860 and all consequential proceedings emanating therefrom. 2.

The prayer for quashing is based on a settlement arrived at between the parties before ASCJ, Shahdara, Karkardooma Court, Delhi in CS no. 10714/2016, where a joint application under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, was filed by Respondent no.2 (Plaintiff therein) and Petitioner (defendant therein) for a consent decree. settlement are encapsulated in the said application. The same was allowed and on 18th April, 2024, decree was passed in terms of the said settlement. 3.

Mr. Manoj Bansal, authorized representative of Respondent no.2 company is present in Court and is duly identified by his counsel. He states that he has no objection to the quashing of the FIR qua the petitioner. 4.

Petitioner is also present in Court and duly identified by the Investigating Officer.

It is noted that this Court had earlier quashed FIR No. 914/2022 against the Petitioner by order dated 6th September, 2024 in W.P.(Crl.) 2749/2024, pursuant a settlement between the parties before the Civil Court. 6.

In view of the foregoing, and given that the parties have settled their disputes and the likelihood of conviction of the Petitioner is remote, continuation of the present proceedings would amount to an abuse of the process of the Court and an unnecessary burden on the State exchequer. The petition is, accordingly, allowed.

Consequently, impugned FIR No. 742/2014 registered at PS Jyoti Nagar, Delhi and proceedings emanating therefrom are quashed qua the Petitioner.

Parties shall abide by the terms of settlement. 9.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
