The present petition seeks to direct the Respondent/Ministry of Heavy Industries to issue a GST Concession Certificate1 for enabling Petitioner to purchase a four-wheeler.

Petitioner, a person with 75% locomotor disability, intends to purchase a four-wheeler and has applied for a GST Concession Certificate for a person with disability. As a pre-requisite for obtaining the said Certificate, Petitioner has obtained a Unique Disability ID Card,2 issued by Ministry of Social Justice and Empowerment on 05th July, 2024. 3.

Petitioner has attempted to apply on the Respondent's website for the GST Concession Certificate, however, despite several attempts, he is unable to successfully submit his application. On every occasion, the website 1 "the Certificate"

reflected an error message "UDID number does not exist. Please enter valid UDID number and date of birth". In some instances, the website also reflected an error message "Website is under Maintenance". Petitioner asserts that he has carefully checked the UDID number but the errors continue to occur. Screenshots displaying the error messages have been are annexed with the petition.

Counsel for Respondent states that prior to filing of present petition, no attempt was made to contact the Respondent. In response, counsel for Petitioner states that he has, on multiple occasions, raised grievance on the helpline numbers provided on the Respondent's website, however, no resolution could be reached.

In view of the above-noted facts, the present petition is disposed of with the following directions:

(a) Respondent shall resolve the issue pertaining to error in the website enabling the Petitioner to submit his application for grant of GST Concession Certificate on time.

(b) In case the above resolution is not effected within ten days from today, Respondent shall accept the paper copy of Petitioner's application and process the same, in accordance with law. 6.

The Court has not expressed any opinion on the merits Petitioner's eligibility. All rights and contentions of the parties are left open. 7.
