Learned Counsel for the Petitioner/tenant draws attention of the Court to order dated 20.08.2015 to submit that the possession of the subject premises was returned to the Respondent on 13.07.2015. 3.

Learned Counsel for the Petitioner relies upon the judgment passed by this Court in Ashok Gupta v. Deepak Rao1, which has relied upon the Judgments of the Supreme Court in NC Daga v. Inder Mohan Singh Rana2 and Vinod Kumar Verma v. Manmohan Verma3 to fairly submit in view of the settled position of law, since the possession of the subject premises has been restored, nothing further survives in the present Petition and the Petition has become infructuous.
