The petitioner has approached this Court under Article 226 of the Constitution seeking action by the Municipal Corporation of Delhi ["MCD"] in respect of alleged unauthorised construction on the front part of property No. 51, Chhappar Wali Masjid, Okhla Village, Jamia Nagar, New Delhi - 110025 ["the subject property"].

MCD has filed a status report dated 17.09.2024, in which it is stated that demolition proceedings have already been initiated and a show cause notice has been issued to the owners/occupants to the subject property on 13.09.2024.

to the show cause notice. In the event a demolition order is required to be passed, the same will be done within the period of four weeks from today and further consequential action will be taken within six weeks thereafter, subject to availability of police force.

In view of the above, no further orders are required in this writ petition, which stands disposed of.

It is made clear that these directions are without prejudice to the rights and contentions of the owners/occupants of the property, whose remedies are expressly reserved. MCD is directed to take action after compliance of all statutory formalities.
