The petitioner has approached this Court under Article 226 of the Constitution seeking directions to the Municipal Corporation of Delhi ["MCD"] to take action in respect of alleged unauthorised construction in property No. H.No. 101, Street No. 5, Block-C, Mukund Vihar, Karawal Nagar, New Delhi.

The MCD has handed over to the Court a status report dated 22.10.2024, in which it is stated that entire property has been booked on W.P.(C) 11758/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 17.09.2024, and a demolition order has also been passed on 21.10.2024. A copy of the status report is taken on record and a copy has also been handed over to learned counsel for respondent No. 4, who claims to be the owner of the property.

In view of the fact that the demolition order has already been passed in respect of the property, no further orders are required in this writ petition, which stands disposed of.

However, Mr.

Rahul Kumar Sharma, learned counsel for respondent No. 4, states that respondent No. 4, wishes to assail the demolition order before the Appellate Tribunal for Municipal Corporation of Delhi ["ATMCD"]. In order to enable him to do so, MCD is directed not to take further action pursuant to the demolition order for a period of three weeks from today. Further action will thereafter be taken, subject to the orders of ATMCD.
