The petitioner vide the present petition under Article 226 of the Constitution of India Section 482 of the Code of Criminal Procedure, 1973 seek quashing of FIR No. 78/2023 dated 01.04.2023 registered under Sections 420/467/468/471/120B IPC at P.S. Kirti Nagar Delhi and all proceeding emanating therefrom in view of the Settlement arrived at between the parties.

A request for quashing of the FIR has been made on account of the Settlement inter se the parties. Pursuant to the settlement, the petitioner and the respondent No. 3 has paid the entire amount of Rs.10 lakhs which was taken by cheating the complainant/respondent No.2. appeared through video conferencing. The parties have been identified by the Investigating Officer concerned.

The respondent No.2/complainant confirms that he has received all amounts due to him and has no objection if the FIR and the consequent proceedings are quashed.

The respondent No. 3/co-accused in the above-mentioned FIR has not joined the proceedings today. Since he has not joined the proceedings, the respondent No. 2/complainant has been asked as to whether he has settled the matter qua respondent No. 3/co-accused also, to which, he submits that he is left with no grievance against the respondent No. 3 and has no objection to the quashing of the FIR qua him. 5.

In view of the fact that the parties have amicably resolved their differences out of their own free will and without any coercion and undertake to remain by their statements, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question. 6.

Accordingly, FIR No. 78/2023 dated 01.04.2023 registered under Sections 420/467/468/471/120B IPC at P.S. Kirti Nagar Delhi and all consequential proceedings emanating therefrom are quashed. 7.

The petition stands disposed of.
