A Criminal Writ Petition under Article 226 read with Article 25 of the Constitution of India and Section 528 B.N.S.S. has been filed on behalf of the Petitioners for the following reliefs :
(i) Direction/Writ of Mandamus to Respondent No-1 & 4 to investigate through Sub Divisional Magistrate/ Crime Branch/ any other appropriate authority into the cause of death of Anup Kumar Bhiku Jethwa; all properties of Anup Kumar Bhiku Jethwa located in India may be identified and it be investigated if any financial fraud has been committed by any person including Respondent No4; if it is found that death of Anup Kumar Bhiku Jethwa is result of some unnatural act then role of Reshma may be investigated into the death of Anup Kumar Bhiku Jethwa and in respect of any financial fraud; FIR be registered and further investigation in accordance with law be carried out in respect of Complaint dated 29.03.2024;
(ii) Direction/Writ of Mandamus to Respondents to provide all the medical document of treatment given to the deceased, Medical examination documents, post mortem Report, Viscera chemical analysis, Histopathology Reports and progress of investigation to the Petitioners;

(iii) Direction/Writ of Mandamus to give details of burial of Anup Kumar Bhiku Jethwa; Exhume body of Anup Kumar Bhiku Jethwa (deceased) and hand over the same to the Petitioners for carrying out his last rites according to Hindu Religion; (iv) Direction/Writ of Mandamus to investigate and register an FIR under appropriate sections of IPC in respect of forged divorce documents submitted by Reshma to Respondent No-4; (v) Direction/Writ of Mandamus to Respondent No-5 to issue correct death certificate with Petitioner No-1 as wife of deceased; (vi) Direction/Writ of Mandamus to Respondent No- 1 to 5 for issuance of "Doctors Certificate of cause of death" of Anup Kumar Bhiku Jethwa as Petitioners has to submit Doctor Certificate with regard to the cause of death of Anup Kumar Bhiku Jethwa who was a USA national for "Issuance of electronic consular Report of death abroad" by the US Embassy at India, and (vii) Pass any other or further Order (s) that this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.

Essentially, the main relief relates to the conduct of Enquiry by the SDM. Learned Counsel for State submits that the Inquest is ongoing. /The FSL Report has been received and the proceedings are likely to be concluded within two weeks. All other reliefs which have been claimed flow from the conclusion of the Inquest Report.

The Petition is disposed of with liberty to the Petitioner to approach the Court afresh, in case need be, after the conclusion of the Inquest Report. NEENA BANSAL KRISHNA, J.
