This petition was scheduled to be listed on 03.03.2026, but has been listed today, as 03.03.2026 was declared a holiday vide Notification No. 64/G-4/Genl.-I/DHC dated 27.02.2026.

By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks grant of regular bail in connection with FIR No. 562/2022, dated 30.05.2022, registered at Police Station Adarsh Nagar, Delhi, under Section 302 of the Indian Penal Code, 1860.

At the very outset, Mr. Tarang Srivastava, learned Additional Public Prosecutor, submits that charges have been framed recently, and evidence of two material witnesses - Sanjay @ Pappi and Abhinandan Pandey is yet to be recorded.

Mr. M.L. Yadav, learned counsel for the petitioner, seeks permission to withdraw this bail application, without prejudice to the petitioner's rights and remedies before the Sessions Court at the appropriate stage. However, Mr. Yadav seeks directions for expeditious recording of evidence of the material witnesses. 5.

I am informed that both witnesses have been summoned, but did not appear before the Trial Court on the last date of hearing. Thus, bailable warrants have been issued against them for the next date of hearing.

Having regard to the period of custody of the petitioner, the Sessions Court is requested to expedite the recording of evidence of the material witnesses, having regard to the position of its Board and pendency of older matters.

Mr. Srivastava assures the Court that the prosecution will not seek any unnecessary adjournments.

The bail application is disposed of with these observations, leaving it open to the petitioner to approach the Sessions Court at the appropriate stage, including in the event, the testimony of the material witnesses is inordinately delayed.

It is clarified that this Court has not made any observation on the merits of the case, and all rights and contentions of the parties in any future application are left open.
