The learned counsel appearing for the appellant has invited our attention to the settlement arrived at between the parties and has relied on the settlement agreement dated 25th August, 2025. 2.
It is urged that not only the payment as was agreed to, as per the schedule mention in the agreement is made, but the appellant shall continue to make the payment as agreed in paragraph 7(ii) of the said agreement. 3.
In view of the aforesaid statement made by the learned counsel for the appellant, which is accepted, the appeal, in our opinion, no more survives. 4.
None appears for the respondent to dispute the aforesaid claim. 5.
That being so, the appeal stands disposed of, in view of the settlement agreement arrived at between the parties.
