O R D E R

% 15.10.2025 1.

The present petition has been filed seeking following reliefs: (A) DIRECTING the respondent bank to provide the calculation for amount looming against the petitioner and schedule the repayment plan for outstanding interest in accordance with the agreed rate @ 9.5% p.a.

(B) DIRECT the respondent bank not to auction the mortgaged property bearing No. D-13A, East Jyoti Nagar, Loni Road, Delhi110093, measuring 158.85 sq. mtrs. (190 sq. yds.) till the disposal of the present writ petition.

(C) PASS any other order or orders as this Hon'ble Court may deem fit under the circumstances of this case. 2.

Mr.Vivek Sharma, learned counsel for the petitioner submits that during pendency of the present petition, the petitioner has paid an amount of Rs.12 lakhs to the respondent bank towards the total outstanding amount of Rs.20 lakhs.

worked out between the parties, the terms of which are as follows: (i) It is agreed that the balance outstanding amount payable by the petitioner to the respondent bank as on date is Rs.20 lakhs inclusive of all charges.

(ii) The said amount of Rs.20 lakhs shall be paid by the petitioner latest by tomorrow i.e. 16.10.2025.

(iii) Upon payment/realisation of the aforesaid amount of Rs.20 lakhs, the respondent shall de-seal the property of the petitioner i.e. First Floor of D-13A, East Jyoti Nagar, Loni Road, Delhi- 110093. 4.

It is made clear that in the event petitioner fails to make the payment of Rs.20 lakhs as undertaken by him latest by tomorrow, the petitioner will not be entitled to take advantage of the aforesaid arrangement and no further indulgence shall be granted by this court. Thereafter, the bank shall be at liberty to proceed against the aforesaid property in accordance with law.

The petition along with the pending application is disposed of in the above terms.

The next date of hearing i.e. 11.11.2025 stands cancelled. 7.
