This hearing has been done through hybrid mode. 2.

The present petition under Section 10 and 12 of the Contempt of Courts Act, 1971 read with Article 21 of the Constitution of India seeks the following prayers: - "i) Initiate contempt proceedings against the Respondents for deliberate and wilful non-compliance of the order dated 23.04.2025 passed in the W.P (C) bearing number 3456/2025. ii) Pass an order/direction directing the respondents/contemnors to implement the order of this Hon'ble Court dated 23.04.2025 passed in the W.P (C) bearing number 3456/2025.

iii) Pass any other order in the interest of justice." 3.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 23.04.2025, the learned Division Bench of this court in W.P.(C) 3456/2025 passed the following directions: - "5. communicate, to the petitioner, the reason for assigning him the seniority position as has been assigned in the impugned seniority list dated 9 September 2024."

Learned counsel appearing on behalf of the respondent nos. 1 to 3 on advance notice submits that the aforesaid directions have been complied with and the representation has been decided vide order dated 31.07.2025. Copy of the same has been handed up in the Court today and the same has been taken on record.

Copy supplied to the learned counsel for the petitioner who submits that in view of the same he seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law before the Court of Competent Jurisdiction.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
