O R D E R
% 08.08.2018 I.A. 10473/2018 Present joint application has been filed under Order 23 Rule 3 read with Section 151 CPC. The same is duly signed by the parties to the litigation as well as by the learned counsel for the plaintiff. Present application is also supported by affidavits of constituted attorney of the plaintiff and the partner of the defendant. Both the parties state that the matter has been compromised in accordance with the terms mentioned in the Settlement Application being I.A. 10473/2018 as well as the undertaking dated 14th May, 2018 contained therein.
Learned counsel for the plaintiff states that the payment of US$ 2000 shall be paid to the defendant within a period of one week.
Both the parties further assure and undertake to this Court that the parties shall comply with the Settlement terms mentioned in the present settlement application and the undertaking annexed thereto. The aforesaid statements, assurances and undertakings as well as undertakings given by the parties are accepted by this Court and they are held bound by the same.
This Court has also perused the compromise application as well as undertaking annexed therein and is of the opinion that the same is lawful. Consequently, the suit is decreed in accordance with the present settlement application being I.A. 10473/2018 as well as undertaking annexed thereto, which are marked as Ex. C-1 (Colly.). Registry is directed to prepare a decree sheet accordingly. With the aforesaid observations, present application is allowed and the suit and all pending applications stand disposed of. The interim order dated 13th March, 2013 stands vacated.
