After hearing arguments for some time, learned counsel for petitioner does not press the present petition. He, however, submits that the application was moved in the right earnest and even if there was no merit in the same, the learned Trial Court should not have been burdened him with a cost of Rs. 5,000/- while dismissing his such application. 2.
Learned counsel for respondent appears on advance notice and submits that he does not insist for payment of cost.

In view of the above, the present petition is dismissed as withdrawn. 4.
However, since respondent/landlord does not insist for payment of cost, petitioner is relieved of the obligation in this regard. 5.
The next date before the learned Controller is stated to be 15.10.2025. 6.
Since the matter has already delayed considerably, this Court expects that the learned Controller would take up the abovesaid application seeking leave to defend and it is expected that both the sides would render due assistance and cooperation in this regard to the learned Controller so that the abovesaid application is disposed of as expeditiously as possible.
