A Bail Application under Section 483 BNSS has been filed on behalf of the Petitioner for Extension of Interim Bail for a period of one month in case FIR No.820/2017 under Section 302/34/120-B IPC and 25/54/59 Arms Act, registered at Police Station Mangol Puri, which has been last extended vide Order dated 22.07.2025 till 02.08.2025.

It is submitted that there is a hole in the heart of son of the Petitioner and he was also suffering from Pneumonia, for which he had been earlier admitted in the Hospital, though he got discharged. Now the RML Hospital has fixed a date for his ECHO Test on 11.08.2025 and AIIMS Hospital has fixed the date of 14.08.2025.

First and the foremost even though the extension had been denied to the Petitioner, he has chosen not to surrender on 02.08.2025 and now filed an Application for extension of Interim Bail. has been admitted in the Navjeevan Hospital yesterday on 05.08.2025 on account of serious health concerns and has sought further extension. 4.

Though, there is no document and there is nothing placed on record to show the admission of the child or the condition of the child, except two receipts giving the date of ECHO Test for which no admission is required and also that despite there being no extension, Petitioner has chosen not to surrender before the Jail Superintendent, but considering the totality of circumstances, the Interim Bail of the Petitioner is extended till 12.08.2025, on which day he shall surrender before the concerned Jail Superintendent. 5.

No further extension of Interim Bail shall be given to the Petitioner on any ground.

The Bail Application stands disposed of along with the pending Application(s).
