Third Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (under Section 439 of the Code of Criminal Procedure, 1973) read with Section 528 of B.N.S.S. (Section 482 Cr.P.C.) has been filed on behalf of the Petitioner, Ankit Bisht @ Nikki for grant of Interim Bail in FIR No. 853/2023 under Section 307/147/148/149 of the Indian Penal Code, 1860, and Section 25/27 of Arms Act, registered at Police Station Keshav Puram, for eight weeks on the ground that the Surgery of the wife of the Petitioner, which has to be performed on 16.08.2025.

On advance Notice, learned APP for the State has appeared and accepted the Notice.

It is submitted that his wife is suffering from severe pain and lower back and has been diagnosed with Neuropathic Spondylopathy lumbar region (lumbar spondylosis) with severe degenerative spinal conditions causing nerve root compression, resulting into acute pain in L4 and L5 region located in the lower back that supports the weight and helps in twisting and bending of the body. The surgery was scheduled for 21.07.2025 but because of her medical condition, the surgery could not be performed. Again, the surgery is scheduled for 16.08.2025. Hence, the prayer for grant of Anticipatory Bail for eight weeks, is sought. 6.
Learned Public Prosecutor has taken serious objection on the ground that for the same surgery, Interim Bail was granted vide Order dated 05.07.2024 for four weeks but interestingly, no surgery got done. This and other grounds have been persistently agitated by the Petitioner, to seek Interim Bail. This is again his ground for seeking Interim Bail. If the surgery was so imminent and important, there is no reason why it has not been done in the last one year.

It is also pointed out that earlier the medical documents were of Fortis, Shalimar Bagh, but now the latest documents have been produced from Fortis, Vasant Kunj. It is submitted that this is nothing but a ploy to get the Interim Bail and the same is opposed.

The documents have been annexed by the Petitioner along with the Application showing that the surgery is scheduled for 16.08.2025. for the Applicant to keep seeking Interim Bails and interestingly, the surgery does not get performed, however, considering the medical documents, the Applicant is granted Interim Bail for a period of two weeks w.e.f.10.08.2025. upon his furnishing a personal bond in the sum of Rs.35,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court, and further subject to the following conditions:- a) The Petitioner shall not leave Delhi/NCR without prior permission of the Court;
b) The Petitioner shall appear before the Court as and when the matter is taken up for hearing;
c) The Petitoner shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;
d) The Petitioner shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi. e) The Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses.
f) The Petitioner shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner. g) Upon expiry of period of two weeks, as stated above, the Petitoner shall surrender before the concerned Jail Superintendent.
