O R D E R

% 29.05.2017 I.A. 6661/2017 Today in Court, learned counsel for the plaintiffs has carried out certain typographical corrections in the application. The said corrections have been duly initialled by the counsel for the plaintiff. It is pertinent to mention that present application has been filed under Order 23 CPC praying for disposal of the present suit in terms of the compromise.

Learned counsel for both the parties state that the matter has been compromised in accordance with the Settlement Agreement dated 22nd May, 2017 executed before the Delhi High Court Mediation and Conciliation Centre. Both the counsel further assure and undertake to this Court that

parties shall comply with the settlement terms mentioned in the aforesaid Settlement Agreement.

This Court has also perused the Settlement Agreement dated 22nd May 2017 and is of the opinion that the same is lawful. The statements, assurances and undertakings as well as the undertakings mentioned in the Settlement Agreement dated 22nd May, 2017 are accepted by this Court and the parties are held bound by the same. In view of the aforesaid, learned counsel for the plaintiffs wishes to withdraw the present suit. Consequently, the present suit and pending applications are dismissed as withdrawn. The next date of hearing is cancelled.

Since the matter has been settled before the Delhi High Court Mediation and Conciliation Centre, the Registry of this Court is directed to issue to plaintiff no. 1 a certificate authorising him to receive back from the Collector the entire court fees paid in respect of the present claim. Order dasti.
