Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioner, Sahil Tyagi for quashing of FIR No.97/2019 under Section 354/506/509/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Inderpuri, New Delhi and all the consequential proceedings emanating therefrom, in terms of the Affidavit/NOC dated 10.06.2025 filed by the Respondent No. 2. 4.

On advance Notice, learned APP has appeared and accepted the Noteice on behalf of the State.

Brief facts of the case are that the Respondent No. 2/Complainant is the paternal aunt and wife of the elder brother of the father of the Petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and a fight had initiated which resulted in the registration of the said FIR. It is stated that on 16.04.2019 at around 9:45 p.m, Sahil Tyagi was drunk and came along with 2-3 more boys to the house of the Respondent No. 2. He hit her chest and abused the Complainant, her husband and the women in the house. Thereafter, the Petitioner threatened the Respondent No. 2 to kill her. Mohd. Moassir and Mohd. Mujahid stand discharged from the present case by the learned Trial Court vide Order dated 23.07.2024. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.97/2019 under Section 354/506/509/34 of IPC, got registered at Police Station Inderpuri, New Delhi.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Affidavit/NOC filed by the Complainant, dated 10.06.2025. 9.

Today, the Respondent No. 2 is present in the Court and states that she has no objection if the said FIR is quashed. 10.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 97/2019 under Section 354/506/509/34 of IPC, registered at Police Station Inderpuri, New and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
