At the outset, learned counsel for the plaintiff seeks permission to withdraw the suit with liberty to bring a fresh suit on the same cause of action.

In the suit, it has been pleaded that the cease-and-desist notice dated 13.06.2025 served on defendant nos. 1 to 3 on the e-mail address mentioned in the memo of parties has bounced back. However, a distinct e-mail address of the defendants is mentioned in the memo of parties vis-à-vis defendant no. 4 and a fresh physical address is also mentioned. The said notice was not served at the said addresses.

The plaintiff is directed to ensure fresh service of its notice and paper book on the defendants at the said address mentioned in the memo of parties.

Accordingly, the present suit is dismissed as withdrawn, with liberty reserved. Pending applications are disposed of.
