O R D E R
% 03.10.2018 Mr. Sumit Bansal, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition at this stage, with liberty to assail the order that may be passed by the South Delhi Municipal Corporation, in relation to his application seeking regularisation of the construction existing in the subject property i.e. Khasra No. 253 behind South Delhi Municipal Corporation, Primary
School, near Kohinoor, Farm House Saidulajab, New Delhi in the event, he is aggrieved thereby.
Learned counsel appearing on behalf of South Delhi Municipal Corporation states that, subject to the petitioner furnishing all the requisite details, they shall determine his application seeking regularisation as aforestated strictly, in accordance with law, within a period of eight weeks from today.
Learned counsel appearing on behalf of the South Delhi Municipal Corporation further states that, in the event the construction existing in the subject property is contrary to law, they shall take appropriate action, in accordance with law, against the same thereafter.
The petitioner is granted leave to withdraw this petition, at this stage, while reserving liberty to him to assail any action that may be taken on behalf of the South Delhi Municipal Corporation, in relation to the regularisation application filed by the petitioner in appropriate proceedings and, in accordance with law.
The petition stands disposed of accordingly.
Pending applications also stand disposed of.
