This application has been filed by the petitioner in a disposed of writ petition seeking a direction against the respondent no.1/MCD to take demolition action against the subject property raised by the respondent no.2. 2.

This Court had disposed of the writ petition vide order dated 6th October 2025, with the following directions:- "6.

Accordingly, the MCD is directed to consider the regularization application of respondent no. 2, in accordance with law, and pass requisite orders.

It is directed that further action shall be taken by the MCD, subject to any order that may be passed in the regularization W.P.(C) 11712/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. application of the respondent no. 2.

It is further directed that till the regularization application of respondent no. 2 is decided, no further coercive action shall be taken against the property of respondent no. 2. It is expected that the regularization application of respondent no. 2 shall be decided by the MCD expeditiously, preferably within a period of 8 weeks, from today. 9.

With the aforesaid directions, the present writ petition, along with the pending application, is accordingly disposed of." 3.

Counsel appearing on behalf of the respondent no.1/MCD submits that on 3rd December, 2025, the regularisation application filed by the private respondent no.2 has been rejected and a demolition order has been passed in January, 2026.

In view thereof, the present application is disposed of while directing the respondent no.1/MCD to take immediate action in accordance with law. 5.

Needless to state, all rights, contentions and legal remedies of the owner/occupier shall remain protected.

CM APPL. 9231/2026 (seeking interim stay) 6.

This application has been filed on behalf of the petitioner seeking to restrain the respondent no.2 from selling, transferring or creating third party interest in respect of the subject property.

No grounds are made out for seeking such relief in a disposed of writ petition.
