The present writ petition has been filed seeking directions to the respondent nos. 1 to 4, to take action against respondent no. 5, in order to stop him from encroaching over the street, i.e., from projecting over The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Issue notice. Notice is accepted by learned counsels appearing for respondent nos. 1 to 4.

Learned counsel appearing for respondent nos. 1 and 2, i.e., Municipal Corporation of Delhi ("MCD"), submits that a Show Cause Notice against the unauthorized construction in the property in question has already been issued on 04th August, 2025. He further submits that requisite action shall be taken against the unauthorized construction, after following the due procedure.

Accordingly, the aforesaid statement made by learned counsel appearing for the MCD is taken on record and the MCD is held bound by the same.

It is directed that the MCD shall take requisite action against the unauthorized construction in question, after following the due procedure, and in accordance with law.

In case the petitioner is aggrieved by any non-action on part of the respondents, the petitioner shall have the liberty to seek her remedies in accordance with law.

Likewise, the right of respondent no.5 to seek his remedies is also preserved, in case respondent no.5 has any grievance with regard to any action being taken by the respondent-MCD.

The local police of Police Station Hari Nagar is directed to cooperate with the MCD, and provide requisite police force, as and when action is proposed to be taken by the MCD.
