The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) seeks quashing of FIR No. 366/2019 under Sections 420/406/34 of the Indian Penal Code, 1860, registered at P.S. Alipur and all proceedings emanating therefrom.

The instant petition has been filed on a compromise between the Petitioner and Sh. Satpal (Respondent No. 2) & Sh. Purshottam Kumar (Respondent No. 3). In the present petition, Respondents No. 2 and 3 have given their no objection to the quashing of the FIR and have further stated that, pursuant to the Memorandum of Understanding dated 12th June, 2021, a sale deed has already been executed in their favour. 3.

Nonetheless, considering that the offences in question, i.e. Sections 420 and 406 of the IPC, are compoundable in nature, and since the chargesheet has also been filed under these provisions, the Court is of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. view that the Petitioner may instead seek compounding of the offences. 4.

Accordingly, the present petition is disposed of along with the pending application(s), with a clarification that this Court has not examined the merits of the case. The Petitioner shall be at liberty to apply for compounding of the offence before the Trial Court in accordance with law. 5.
