The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (formerly Section 439 of the Code of Criminal Procedure, 19732) seeks interim bail for a period of 30 days, in the proceedings arising from FIR No. 78/2023, registered at P.S. Wazirabad for the offences under Sections 307/323/34 of the Indian Penal Code, 18603. Subsequently, a chargesheet was filed, whereunder the Applicant has been charge-sheeted with Sections 302/325/147/149/201/34 of the IPC. 2.
The Applicant seeks interim bail on humanitarian grounds, citing the medical condition of his mother who is scheduled to undergo gallbladder 1 "BNSS"

removal surgery. In this regard, this Court had directed the State to file a status report. In compliance thereof, the State has submitted the status report, a copy whereof has been handed over across the board, and is taken on record.

As per the status report, the medical condition of the Applicant's mother has been verified. The surgery is scheduled to be conducted at Lok Nayak Hospital on 25th August, 2025. It is further noted that the Applicant's mother does not suffer from any comorbidities. In the event the surgery is performed laparoscopically, the anticipated recovery period is stated to be between two days to one week. The State has also submitted that, although there are other relatives with whom the Applicant's mother shares cordial relations, they are distant relatives.

Furthermore, as per the latest nominal roll placed on record, the Applicant has been in custody for 2 years, 5 months, and 7 days as of 13th August, 2025. His overall jail conduct as well as conduct over the past one year have been described as good.

Considering the above, and in view of the fact that there is no immediate family member available to attend to the needs of the Applicant's mother, this Court is inclined to allow the request on humanitarian grounds. Accordingly, the Applicant is directed to be released on bail for a period of 10 days and subject to the satisfaction of the concerned Jail Superintendent/Trial Court/ Duty MM on the following conditions: (a) The Applicant shall surrender before the Jail Superintendent/Trial Court/ Duty MM, on or before the expiry of 10 days from the date of release;
(b) The Applicant shall, under no circumstance, leave the NCT of Delhi, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
without permission of the Trial Court, during the period of his release; (c) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, in any manner whatsoever;
(d) The Applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO;
(e) The Applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times. (f) The Applicant shall not commit any offence during the period of his release.

In the event of there being any FIR/DD entry/complaint lodged against the Applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 7.
It is clarified that any observations made in the present order are for the purpose of deciding the present bail application and should not influence the outcome of the trial and shall also not be taken as an expression of opinion on the merits of the case.
