The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) seeks quashing of FIR No. 163/2019 under Sections 420 and 406 of the Indian Penal Code, 1860, registered at P.S. Alipur and all proceedings emanating therefrom.

The Petitioner places reliance on the Settlement/Compromise Deed dated 12th June, 2021 executed between him and Late Sh. Subhash Chand Jain and other parties. According to the Petitioner, on the basis of the aforenoted Compromise Deed, the disputes with the Complainant stood resolved.

It is noted that Respondents No. 2 and 3 have been impleaded in the present proceedings as the legal heirs of the deceased Complainant, Late Sh. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Subhash Chand Jain. Respondents No. 2 and 3, who are present before the Court, state that they became aware of the present petition only upon receiving a call from the Investigating Officer, requesting their appearance in the matter. They submit that they are not in a position to confirm the settlement at this stage, as the copy of the paper book has been supplied to them today itself, and they require time to go through the same 4.

Nonetheless, considering that the offences in question, i.e. Sections 420 and 406 of the IPC, are compoundable in nature, and since the chargesheet has also been filed under these provisions, the Court is of the view that, in case, there is indeed a settlement, the Petitioner may instead seek compounding of the offences.

Accordingly, the present petition is disposed of along with the pending application(s), with a clarification that this Court has not examined the merits of the case. The Petitioner shall be at liberty to apply for compounding of the offence before the Trial Court in accordance with law.
