In the light of the order dated 08th September 2025, counsel for the Decree Holder, in whose favour the Arbitrator has passed award in Arbitration Petition No.460/2023, states that a fresh claim petition shall be submitted qua the execution of the award.

In view of the aforesaid statement coming from the Decree Holder, we see no reason to continue with the present Appeal, as the subject matter therein has been rendered infructuous in view of the aforesaid development, viz. the order of the Arbitrator dated 08th September 2025 (supra). 3.

Fresh claim petition, if so filed by the respondent, shall always be subject to the legal remedies available to the parties in accordance with law. 4.

The Appeal, accordingly, stands disposed of.
