This is a petition filed under section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal to make and publish the award.

Ms. Kapoor, learned counsel for the respondent joins through VC and states that she has filed a reply. However, the same is not on record. 3.

She states that in the reply it has been averred that Clause 16.7 of the Master Service Agreement contemplates an Arbitral Tribunal of 3 members and since the Arbitral Tribunal is of a Sole Arbitrator, the present petition cannot be allowed.

I am unable to agree with the said contention. 5.

The Sole Arbitrator was appointed by this Court vide Order dated 05.07.2023 and the present petition only concerns extension of the mandate The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. of the Arbitral Tribunal. Further, there is no petition challenging the constitution of the Arbitral Tribunal. Admittedly, it is stated that the Arbitrator has already concluded the proceedings and the matter is only listed for pronouncement of the Award.

I am satisfied that sufficient cause has been shown. 7.

For the said reasons, the petition is allowed and the mandate of the Arbitral Tribunal is extended by a period of 6 months from today. 8.

The period from 21.08.2025 till today stands regularized. 9.

All legal contentions of the respondent are kept open to be adjudicated as and when raised in the appropriate proceedings. 10.

The petition is disposed of.
