This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal to complete the arbitral proceedings.

insurance, unloading, handling storage at the site, erection, integration, training, testing and commissioning of all equipment and materials and Annual maintenance Contract for Fiber Optic Communication System for NDMC SCADA/DMS Project, Petitioner filed the petition in this Court under Section 11(6) of 1996 Act, being ARB. P. 431/2023 seeking appointment of the Arbitral Tribunal, which was allowed on 04.09.2023 and Arbitral Tribunal was constituted to adjudicate the disputes. It is stated that the arbitral proceedings are at the stage of final arguments and the mandate of the Arbitral Tribunal is expiring on 04.10.2025. 5.

Issue notice.

Mr. Apoorv P. Tripathi, learned counsel for the Respondent accepts notice and, on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitral Tribunal. 7.

Accordingly, with the consent of the parties and considering that the arbitral proceedings are at the stage of final arguments, mandate of the Arbitral Tribunal is extended by a period of 09 months from 05.10.2025. 8.

Petition is allowed and disposed of in the aforesaid terms.
