Learned counsel for respondent nos.4 & 5, on instructions, states thatresidential plot on Khasra no.25 admeasuring700 Sq.mtr.situated in Village Kyari Kham,Tehsil Ram Nagar, District Nainital, Uttarakhand, shall not be disposed of, or any third party interest shall be created, till the arbitrator decides the claim.

The aforesaid statement is coming on instructions and the same is accepted with an undertaking to this Court.

That being so, we deem it appropriate to dispose of the present Writ Petition.
