% 24.03.2017 Vide the impugned order dated 15.10.2016 passed by the Learned District and Sessions Judge in an appeal under Section 9 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971 (hereinafter referred to as the P.P.Act), the matter had been remanded back to the Estate Officer for recalculation of the amount payable by the bank i.e. the petitioner to the respondent. While remanding the matter no date had been fixed before the Estate Officer. In the first instance, the parties will appear before the Estate Officer and get an adjudication done in terms of the order dated 15.10.2016. Parties are directed to appear before the Estate Officer on 12.4.2017. This Court notes that the petitioner has assailed various other grounds of the judgment dated 15.10.2016. These issues are left open;
they shall be taken up after a decision has been made by the Estate Officer in terms of the directions contained in the order dated 15.10.2016. This petition is disposed of giving opportunity to the petitioner to assail issues in the order dated 15.10.2016 but after the decision by the Estate Officer.
