CORAM:

HON'BLE MR. JUSTICE MANOJ JAIN

O R D E R

% 28.08.2024 1.

After hearing arguments for some time, learned counsel for the petitioner states that he does not press the present petition. 2.

The petition is, accordingly, dismissed as not pressed. 3.

It is made clear that the grievance raised in the present petition was merely limited to the dismissal of the application moved under Order VII Rule 11(d) CPC and does not concern with respect to the direction whereby opportunity to file affidavit of admission/denial of documents has been closed by the learned Trial Court. 4.

It is contended by the learned counsel for the petitioner that he has already moved appropriate application in this regard before the learned Trial Court.

5.

The learned Trial Court would be at liberty to deal with the aforesaid application irrespective of the withdrawal of the present petition.
