The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No.537/2015 registered under Sections 363/366 IPC at P.S. Khyala, Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, the allegations in the present FIR pertain to the offence of kidnapping of the complainant's daughter.

Learned counsel for the petitioner submits that the daughter of the complainant and the petitioner are married now and even a child is also borne out of the wedlock.

Learned APP for the State submits that in the present case the petitioner is the only accused person and respondent No.2 is the only complainant/victim.

entered into a settlement on 17.11.2023 vide Settlement Agreement and in terms of the settlement, respondent No.2 is now left with no claim whatsoever against the present petitioner.

The petitioner, who is present in the Court, has been identified by his counsel as well as by the Investigating Officer. Respondent No.2 as well as his daughter, who are also present in the Court, have also been identified by the Investigating Officer.

Respondent No.2 states that he has no complaint against petitioner No.1 and further states that he has entered into the aforesaid settlement with his own free will, volition and without any coercion. Respondent No.2 and his daughter further state that they have no objection if the present FIR and consequent proceedings are quashed.

Learned counsel for the petitioner submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed 11.
