After some arguments, the learned counsel appearing for the appellant submits that although the learned Commercial Court has returned the plaint for being presented before a competent court, he was not provided the opportunity to invite directions for presentation of the plaint to a particular Court and for listing the plaint on a particular date before the said competent Court. He submits that appellant would be satisfied if such directions are issued to obviate further delay. He requests this Court to pass the appropriate order in this regard.

Mr.Dey, who appears in person through video conferencing states that he has no objection to this request.

Accordingly, we direct that the plaint be presented before the District Judge, Dwarka Courts, Delhi within a period of two weeks from today.
