% 24.04.2024 By way of the present petition filed under section 34 of the Arbitration & Conciliation Act 1996 ('A&C Act'), the petitioner has impugned arbitral award dated 19.04.2023 rendered by the learned Sole Arbitrator in relation to the disputes between the parties. Though preliminary objections, as to whether the initial filing made by the petitioner on 19.07.2023 was non-est; and whether the pecuniary value of the matter falls within the pecuniary jurisdiction of this court, were raised on behalf of the respondents, after a brief hearing in the matter, and without making any observations as regards those objections, this court is of the view that, in any case, the grounds of challenge to the arbitral award as set-out in the petition relate to the merits of the disputes that had arisen between the parties, which have been decided by the learned Sole Arbitrator. In the opinion of this court, the grounds of challenge are therefore beyond the remit of this court under section 34 of the A&C Act; and this court is therefore not inclined to interfere with the findings arrived at by the learned Arbitrator.

In the circumstances, this court is not persuaded to entertain the present challenge, which is dismissed on merits. The petition is dismissed and disposed-of accordingly.
