The petitioner has filed the present petition, inter alia, praying that the petitioner be not dispossessed or disturbed from carrying on his trade form his site in and around India Gate, New Delhi. The petitioner also prays that a direction be issued to the respondents / Town Vending Committee to conduct the survey of the petitioner in a time bound manner. 2.
The learned counsel appearing for the respondents submit that the petitioner has been granted the license for hawking of aerated water on a hand cart. The license specifically mentions: "fixed site not allowed". He submits that respondents have no objection if the petitioner carries on his vending activities within the territorial limits of NDMC as per the terms and conditions of the license.

In view of the above, the petitioner's apprehension that he would be dispossessed / disturbed from carrying on his trade is addressed. Insofar petitioner's prayer that a direction be issued to the respondents for conducting a time bound survey is concerned, this Court is informed by the learned counsel for the respondents that a survey would be held shortly. 5.
The petitioner is also at liberty to apply during the survey along with all documents in support of his claim.
