By way of the present petition under Article 226 of the Constitution of India, the petitioner, who is serving in the Central Industrial Security Force (CISF), has approached this Court seeking following reliefs: "A. Issue a writ of mandamus or any other writ, order, or direction to the Respondents to grant the Petitioner basic pay of INR 7510/-, in terms of the benefit granted by this Hon`ble Court vide the judgment dated 30.11.2018 in Vinoj VV & Ors. vs UOI & Anr (W.P. (C) 10660/2016) and order dated 05.08.2020 in Malkhan Singh & Ors. vs UOI & Anr (W.P. (C) No. 4905/2020); and B. Issue a writ of mandamus or any other writ, order or direction to the Respondents to extend / grant all the reliefs and benefits as may flow consequent to grant of prayer (A).

C. Pass such and any other order as this Hon`ble Court may deed fit in the interest of justice."

respondents and fairly submits that taking into account this Court‟s decision dated 30.11.2018 in WP(C) No. 10660/2016 titled as "Vinoj VV & Ors. vs. Union of India & Anr.", which was followed in WP(C) No. 4905/2020 titled as "Malkhan Singh & Ors. vs. Union of India & Ors.", the respondents would consider the case of the petitioner in light of the principles laid down in the abovementioned decisions and in case, he is found to be similarly placed as the petitioners in Vinoj VV & Ors. (supra), the same relief as granted to the petitioners in the said decision will be extended to the petitioner as well.

In the light of this fair stand taken by the respondents, we dispose of the writ petition by directing the respondents to consider the case of the petitioner in terms of the decision in Vinoj VV & Ors. (supra) within a period of eight weeks.

In case, it is found that the petitioner is similarly situated as the petitioners in Vinoj VV & Ors. (supra), consequential benefits including arrears will be released to the petitioner within twelve weeks thereafter.
