The present petition has been filed by the Petitioner- Mrs. Parveen under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita seeking issuance of a writ in the nature of habeas corpus for seeking production of her daughter - Ms. 'A' before this Court.

As per the Petitioner, the brief facts of the case are that Ms. 'A' was married to Respondent No. 4 which was solemnized on 10th March 2023. It The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

is alleged in the petition that she was ill-treated by Respondent No. 4 and her in-laws. She had earlier filed complaints against the in-laws but was assured that there would be no harassment. However, on 12th August 2024 the Petitioner claims to have received a text message from her daughter stating that she continues to suffer harassment at the hands of Respondent No. 4. In view thereof, complaints were lodged on 13th August 2024 and 21st August 2024 with the SHO and DCP P.S. Shahdara. Thereafter, the Petitioner has preferred the present petition.

After filing of the petition, a status report dated 28th August, 2024 by the SHO PS Mansarovar Park has been handed over in Court today. The said status report is taken on record.

The Status Report reflects that an earlier complaint had been lodged on 29th April, 2024 by the girl alleging harassment by the in-laws and husband. Thereafter the said complaint was closed at her request. However, after the, closure of the said complaint, another complaint was received on 29th May, 2024 at CAW Cell, Rohini District in which an enquiry is currently pending. On 2nd August, 2024, she visited the CAW Cell along with her husband, however, due to the enquiry Officer being on leave the enquiry could not be proceeded with. The status report also reflects that further complaints filed on behalf of the petitioner had been received on 13th August, 2024 and 21st August, 2024 in which inquiry was underway.

The daughter/girl - Ms.' A' has now joined the mother. The girl has been produced and on being asked, she submits that she wishes to live with her mother and does not wish to go back to her matrimonial home. 8.

In view thereof, the present petition is disposed of and no further orders are called for.

Let the husband of the girl be informed of today's order passed by the Court through the SHO concerned.
