After hearing arguments for some time, learned counsel for petitioner does not press the present petition.

He, however, submits that since the case is already at the stage of final arguments, learned Trial Court may be requested to decide the matter on the basis of evidence adduced by the parties, without being influenced by order dated 05.07.2024, whereby his application moved under Order VII Rule 10/11 CPC has been dismissed.

In view of the above, the present petition is hereby disposed of as not pressed.

Needless to say, the learned Trial Court would adjudicate the suit as per the evidence led by the parties, without being influenced by the order impugned herein.
