The present writ petition has been filed for directions to the respondent nos. 1 to 3, to stop the illegal and unauthorized construction being carried out on property bearing No. 893/8 and 893/8A, Ward No.8, Mehrauli, New Delhi-110030, with a further prayer to take action against the said unauthorized construction being carried out by respondent nos. 4 and 5. 2.
Learned counsel appearing for respondent no.1, i.e., Municipal Corporation of Delhi ("MCD"), on advance notice, submits that action against the unauthorized construction in the property in question, has already been taken on 22nd April, 2025, and 28th April, 2025. 3.
He submits that further demolition action is now fixed for 12th August, 2025.

MCD is taken on record.

It is directed that in case of any on-going unauthorized construction in the property in question, the same shall be stopped forthwith by the MCD, with the assistance of local police, from the Police Station Mehrauli. 6.
The MCD is held bound to take time a bound action to remove the unauthorized construction from the property in question. 7.
However, the right of respondent nos.
and 5, i.e., the owners/occupiers of the property in question is reserved. In case, respondent nos. 4 and 5 are aggrieved by any action being taken by the MCD, they have the liberty to seek their remedies in accordance with law. 8.
In case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall be at liberty to approach the Special Task Force ("STF") constituted by the Supreme Court, in terms of the orders of the Division Bench passed in Devender Versus Govt. of NCT of Delhi and Ors., in W.P.(C) 1807/2018 and Fazruddin Versus DDA and Ors. in W.P.(C) 4649/2017.

With the aforesaid directions, the present writ petition, along with the pending applications, stands disposed of.
