An application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for grant of regular bail in FIR No. 0360/2019, under Sections 419/420/468/471 IPC and Sections 7/13 of Prevention of Corruption Act, 1988, registered at PS: Crime Branch.

In brief, as per the case of prosecution, Nirvar Singh (since deceased) along with his wife (petitioner), who are Afghani Nationals, were arrested on 14.04.2024 on allegations of submitting fake documents and obtaining false verification reports in order to obtain Indian Passports. 4.
Learned counsel for petitioner submits that entire alleged transaction was managed by petitioner's husband who has since expired in custody. He further submits that petitioner has two young daughters to look after. It is pointed out that chargesheet has been filed and petitioner is no longer required for purpose of investigation. Petitioner is also stated to have already applied for Indian citizenship under the provisions of Citizenship (Amendment) Act, 2019.

On the other hand, learned APP for the State opposes the application and submits that racket of false verification reports for obtaining passports came to the notice of ACP Vigilance and it was revealed that 343 persons have been able to get forged passports. He further submits that some of the concerned Police officials have also been dismissed and the case is under further investigation.

Apparently, out of six accused who are alleged to be involved in preparation of forged passports, four accused have been released on bail. Nirvar Singh (petitioner's husband) has already expired in custody which is confirmed by IO. Petitioner is a woman and entire transaction for obtaining passports is claimed to have been managed by her husband. Considering the facts and circumstances, since petitioner is a woman, and is required to look after two young daughters, she is admitted to bail on furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) with one surety in the like amount to the satisfaction of the learned Trial The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
