Petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners, for quashing of FIR No.0161/2025 dated 06.03.2025 under Section 115(2)/126(2)/3(5) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'B.N.S.) registered at Police Station Moti Nagar and all the consequential proceedings emanating therefrom, in terms of the Settlement Deed dated 05.07.2025.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

misunderstanding between the Petitioners and the Respondent No. 2, a quarrel broke between the parties and both end up hurting and injuring each other and lodged Complaints against each other, which culminated into cross-FIR No.0162/2025 under Section 118(1)/3(5) of B.N.S. dated 06.03.2025 registered at Police Station Moti Nagar and Section 118(1) was subsequently converted to Section 118(2).

On the Complaint of the Respondent No.2/Complainant, FIR No.0161/2025 dated 06.03.2025 under Section 115(2)/126(2)/3(5) of B.N.S., got registered at Police Station Moti Nagar.

With the interventions of the well-wishers, family member and respectable member of the society, the Petitioners and the Respondent No. 2 have amicably settled the said FIRs, as well as, all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 05.07.2025. In the Settlement, it was inter alia settled between the parties that they shall not challenge or dispute the validity and legality of the aforesaid Settlement dated 05.07.2025. 7.

Today, the Respondent No. 2, who is present in the Court, states that he has no objection if the said FIR is quashed. Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No.0161/2025 dated 06.03.2025 under Section 115(2)/126(2)/3(5) of B.N.S., registered at Police Station Moti Nagar and all the consequential proceedings emanating therefrom are quashed. The Petition is disposed of accordingly.
