% 29.08.2024 CRL.M.A. 25717/2024 (for exemption) 1.

Exemptions allowed, subject to all just exceptions. 2.

The application stands disposed of.

CRL.M.C. 6734/2024 3.

The present petition is seeking quashing of FIR No. 561/2022 dated 30.07.2022, registered at Police Station Begum Pur, for offences under Sections 420/448/427/34 of the Indian Penal Code, 1860 ('IPC'). The FIR was registered on a complaint given by Respondent No. 2.

4.

The present dispute is with regard to the ownership of a property bearing Plot No. 55, Gali No. 14, 30 feet road, Sukhbir Nagar. It is alleged that the said property is owned by Respondent No. 2 and the petitioners tried to vandalize it and gain illegal control over the same which led to registration of the CRL.M.C. 6734/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. aforementioned FIR.

5.

The present petition is filed on the ground that with the intervention of friends and well-wishers, the matter is amicably settled between the parties of their own free will, without any coercion, pressure, undue influence, force, misrepresentation or mistake and a Memorandum of Understanding dated 27.08.2024 has been signed by the parties to this effect. All the terms of settlement have been complied with by the parties. 6.

The parties are present in person and have been duly identified by the Investigating Officer.

7.

The complainant, on being asked, states that he has received the settlement amount and he does not wish to pursue any proceedings arising out of the present FIR. He submits that he has no objection if the present FIR is quashed. 8.

Offences under Sections 420/427/448 of the IPC are compoundable.

9.

This Court is of the opinion that no useful purpose would be served by relegating the parties to the learned Trial Court for filing an application to compound the offence. 10.

Keeping in view the nature of dispute and that the parties have amicably entered into a settlement, this Court feels that no useful purpose would be served by keeping the dispute alive and continuance of the proceedings would amount to abuse of the process of Court.

11.

In view of the above, FIR No. 561/2022 and all consequential proceedings arising therefrom are quashed. 12.

The present petition is allowed in the aforesaid terms. AMIT MAHAJAN, J AUGUST 29, 2024 "SS"
