This is a petition under Section 528 BNSS for setting aside the order dated 26.07.2025 passed by the learned Sessions Court dismissing the application of the petitioner for cancellation of non-bailable warrants in default as also for quashing of the order dated 02.07.2025 by which nonbailable warrants were issued against the petitioner. 2.

Perusal of the record reveals that petitioner did not appear before the trial court on 02.07.2025. His bail bond was forfeited and non-bailable warrants were issued against him with notice to the surety. 3.

Petitioner filed an application for cancellation of non-bailable warrants which was listed for 26.07.2025. Since no one appeared for the petitioner at the call of the case, his application for cancellation of nonbailable warrants was dismissed in default for non-appearance. The petition is disposed of granting liberty to the petitioner to file fresh application before the trial court for cancellation of non-bailable warrants. As and when such an application is filed, the same be decided on its own merits by the trial court.

The petition, accordingly, stands disposed of in terms of the aforesaid order.
