At the very outset, learned counsel for the plaintiff seeks permission to withdrawn the suit with liberty to file a fresh suit after compliance with the provisions of Section 12A of the Commercial Courts Act, 2015.

The suit, alongwith all pending applications, is dismissed as withdrawn with liberty as aforesaid.

In view of the fact that the suit has been withdrawn voluntarily at a preliminary stage, the Registry is directed to refund the Court fees to the plaintiff.

Copy of this order be given dasti under the signature of the Court Master.
