The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (formerly Section 439 of the Code of Criminal Procedure, 19732) seeks grant of further interim bail in proceedings arising from FIR No. 882/2015 registered under Sections 302/307/34 of the Indian Penal Code, 18603 at P.S. Nihal Vihar. 2.

The Petitioner seeks bail on health grounds. It is pointed out that, on earlier occasion, this Court by order dated 6th June, 2025, in Bail Appln. No. 2132/2025, had granted bail to the Petitioner for a period of 30 days to enable him to undergo treatment for his chronic kidney disease. 3.

Subsequently, in another bail application Bail Appln. No. 2415/2025, taking note of the fact that Petitioner was undergoing treatment, the interim 1 "BNSS"

bail was extended for a period of 30 days, on the same terms and conditions. However, despite availing treatment during the said period, his condition has not improved.

In this background, Petitioner seeks further extension for a period of two months. The Petitioner has annexed his medical report to support his request. It is submitted that as per the medical report there is a high risk of deterioration of renal function and a potential need for dialysis if the Petitioner undergoes surgery. Accordingly, it was recommended that surgery be deferred until there is an improvement in renal function, and that if symptoms persist, the surgery may be considered at a later date. 5.

In the above circumstances, the application is allowed on humanitarian grounds and the bail granted to the Petitioner on 6th June, 2025, as extended by order dated 8th July, 2025 is directed to continue for a period of 30 days, on the same terms and conditions. 6.

The petition is disposed of, along with pending application. 7.

Copy of the order be sent to the concerned Jail Superintendent, for necessary information and compliance.

Investigating Officer shall, in the meantime, also verify the medical records. In case, upon verification, any discrepancy is pointed out, the State shall be at liberty to apply for suitable directions.
