W.P.(CRL) 676/2017 Issue notice. Notice is accepted on behalf of the respondents. The petitioner has preferred the present writ petition to seek the quashing of FIR 350/2012 under Section 498A/406/34 IPC lodged by respondent No.2/ wife and the proceedings arising therefrom.
Counsel for respondent No.2 has put in appearance. At the outset, he points out that a quashing petition preferred by Neetu Singh, the sister of
petitioner no.1 who is also a co-accused in the said case has already been dismissed by this court. This fact has not been disclosed in the present petition and the same has been suppressed by the petitioner. Moreover, Ms. Rao has pointed out that the charge sheet already stands filed and is coming up 10.04.2017 for arguments on charge. In these circumstances, I am not inclined to exercise extraordinary writ jurisdiction in the facts of the present case. It shall be open to the petitioners to argue on the aspect of charge before the Trial Court and take all pleas which have been raised in the present petition. Dismissed.
