After some arguments, the counsel for the appellant, on instructions, seeks to withdraw the appeal.

The learned counsel for the appellant says that he will approach the family court with an appropriate application to concede that the divorce petition filed on behalf of the respondent should be allowed on the ground that the appellant is suffering from mental disability; a condition which he had when the parties entered into matrimony.

If such an application is moved, the concerned family court will consider the same at the earliest.

The appeal is dismissed as withdrawn with the aforesaid observations. 5.
Consequently, pending applications shall stand closed.
