A Criminal Revison Petition under Section 401 Cr.P.C has been field on behalf of the Petitioner against the Judgment dated 06.03.2010 in CA No.20/09 whereby the conviction of the Petitioner under Section 2(ia) (a) (m) read with Section 16(i) and Section 7 of the PFA Act, 1954 vide Order dated 06.04.2010 and Sentence to undergo six months SI and fine of Res.5,000/- has been upheld.

Learned Senior Advocate on behalf of the Petitioner submits that the incident pertains to the year 1994 and the learned ASJ had upheld the Conviction vide Order dated 06.03.2010. The Petitioner has suffered for the 32 years and does not intend to challenge the Order of Conviction but prayes for leniency in the Sentence.

It is submitted that he has already suffered 14 days judicial custody after his conviction was upheld by the learned ASJ vide Order dated 06.04.2010.

now 62 years of age and that he had stopped this business of manufacturing of synthetic vinegar since long. Considering that he has suffered a lot in the last 32 years, the Order of Sentence dated 21.04.2009 upheld by the judgment of learned ASJ dated 06.03.2010 be modified. 5.
Learned APP for State submits that appropriate Order in the circumstances of the case may be passed.

The incident pertains to the year 1994. The Petitioner is now aged 62 years and has already stopped his business which led to the present conviction. He has already suffered much during this protracted trial of 32 years. He has already undergone judicial custody of 14 dyas after his sentence was upheld by the learned Sessions Court. 8.
Taking the totality of circumstances in consideration, the Order on Sentence is hereby modified and the Petitioner is directed to be released for the period already undergone by him. However, the fine of Rs.5,000/- is enhanced to Rs.10,000/-.

The Petitioner has already deposited fine of Rs.5,000/-. The remaining amount of Rs.5,000/- be deposited within seven days. 10.
The Revision Petition is hereby disposed of.
