CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 29.03.2017 CM No.12561/2017 By the present application the petitioner seeks a clarification in respect of order dated 17.2.2017 passed by this court while disposing of the present petition.

Learned counsel appearing for the petitioner submits that despite the order passed by this court on 17.2.2017 the trial court has on 22.2.2017 not permitted the petitioner to tender the documents on record as directed by this court and has placed the matter for final arguments. A perusal of the order shows that none had appeared for the petitioner when the matter was called out. The counsel appeared at 12 PM whose presence was marked. This was after the order was passed. CM(M) 194/2017

Keeping in view the above, the petitioner may move an application before the trial court placing on record a copy of the order of this court dated 17.2.2017. The trial court is requested to deal with the matter as per directions passed by this court on 17.2.2017. All consequential reliefs that would flow from the order of this court dated 17.2.2017 may also be allowed to the petitioner.

Application stands disposed of.
