HON'BLE MR. JUSTICE ANISH DAYAL

O R D E R

% 29.08.2025 1.

Ms. Rachita Garg, Advocate appears on behalf of respondent, and states that issuance of the Caste Certificate of petitioner has not been processed for the reason that petitioner applied for the same before SubDivisional Magistrate ('SDM'), Dwarka, while petitioner is a resident of Delhi Cantonment, and this application should be moved before SDM Delhi Cantonment.

2.

A communication has been handed over, signed by the Executive Magistrate, Dwarka, which states that, as per field verification and the report of the Halka Patwari, address of petitioner falls within the jurisdiction of Delhi Cantt sub-division and not within the jurisdiction of Dwarkasub-division.

3.

Since the application for issuance of the ScheduledCasteCertificate is online, it can only be processed by competent authority of Delhi Cantt subdivision and not from the Dwarka sub-division. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/09/2025 at 12:22:14

4.

It is also stated that petitioner-applicant had already been informed about this, since his residence falls within the jurisdiction of Delhi Cantt. However, petitioner has repeatedly applied to the Dwarka office, which has led to the rejection of application.

5.

Having perused this communication and taking the statement on record, counsel for petitioner states that they will accordingly move and file a fresh application for issuance of the Scheduled Caste Certificate with the SDM, Delhi Cantt sub-division.

6.

In case an objection is again raised, for any reason, relating to the jurisdiction of Delhi Cantt.sub-division, petitioner will be at liberty to approach this Court, in which case, if statement of the Executive Magistrate is found incorrect on any account, leading to any loss of time for petitioner, requisite directions would have to be passed. 7.

Petitioner is a minor child aged about 14 years old, represented through his father and is studying in class 9 at Prudent School, Sector 22, Dwarka. The Certificate is required to be submitted to his school in September.
