The present review petition has been filed on behalf of the petitioner seeking review of the order dated 05th December, 2025, passed by this Court.

Learned counsel appearing for the petitioner submits that vide order dated 05th December, 2025, this Court while disposing of the writ petition, being W.P.(C) 11955/2024, had directed the petitioner to apply for a fresh Health Trade License, within four weeks from the date of the order. However, the Municipal Health Trade License issued to the petitioner, is still existing and is valid till 31st March, 2026. It is submitted that the revocation of the Municipal Health Trade License issued in favour of the petitioner by the respondent is ex-facie arbitrary and illegal. The respondent had no authority to unilaterally revoke the Municipal Health Trade License, without issuing any notice regarding revocation of the same to the petitioner.

Perusal of the writ petition shows that the following prayers were made in the writ petition, which are reproduced as under: "xxx xxx xxx A. An appropriate writ, order or direction quashing the closure notice dated 16.08.2024 issued by the Respondent against the Petitioner as being arbitrary, irrational, suffering from malafides and/or non-application of mind;

Pass such further and other orders as may deem fit and proper in the facts and circumstances of the present case."

Perusal of the aforesaid prayer clause shows that the only issue in the writ proceedings before the Court, was with regard to quashing of the Closure Notice dated 16th August, 2024.

The issue with regard to revocation of the Municipal Health Trade License by the Municipal Corporation of Delhi ("MCD"), and the legality or illegality of the said action of the MCD was never raised before this Court. 7.

The fact remains that since the earlier Municipal Health Trade License in favour of the petitioner was revoked on 18th August, 2024, it cannot be said that the there is any Municipal Health Trade license in favour of the petitioner, as on date.

In case, the petitioner wishes to challenge the said action of the MCD for revocation of the Municipal Health Tarde License on 18th August, 2024, the petitioner is at liberty to seek its remedies, in accordance with law. 9.

No case for review is made out.

Accordingly, the present review petition, along with the pending applications, is dismissed.
